Terms.
Last updated: October 11, 2026
1. Agreement to Terms
These terms govern the use of ElevateOne.ai, a service provided by O2O Insights GmbH for business purposes. They form part of the service agreement when validly agreed at its conclusion. Individual agreements take precedence. Merely visiting this website does not constitute acceptance of a paid contract.
2. Subscription License
Subject to your compliance with these Terms and, for paid offerings, timely payment of all fees due, O2O Insights GmbH grants you a limited, non-exclusive, non-transferable and non-sublicensable right to use the Service for your own business purposes within the scope of your chosen free or paid offering. This includes the intended marketing features and use of the content created with them for your business. This is a license to use the Service, not a sale or transfer of rights to the underlying software or intellectual property.
- Sublicense, resell, transfer, or otherwise make the Service available to any third party
- Modify, adapt, or create derivative works based on the Service or its underlying technology
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
- Remove, alter, or obscure any proprietary notices, labels, or marks on or within the Service
- Use the Service to develop or offer a competing product or service
- Access or use the Service by any means other than through the interface expressly provided by ElevateOne
Your right to use the service ends upon valid termination of your service agreement. Measures in response to breaches are governed by section 7. Mandatory statutory rights of use, in particular under sections 69d and 69e of the German Copyright Act, are not restricted by these license terms.
3. User Accounts
You must provide accurate, up-to-date account information and protect your credentials against unauthorized access. Inform us if you notice misuse. We will generally give you an opportunity to correct inaccurate information. Suspension or termination is governed by section 7; your responsibility for breaches is determined by applicable law.
4. User Content
Our Service may allow you to upload, submit, or otherwise provide certain information, data, text, graphics, or other material ("Content"). You are responsible for the Content you provide through the Service, including its legality, accuracy, and appropriateness.
By providing Content through the Service, you grant O2O Insights GmbH a limited, non-exclusive license to use, process, and store such Content solely as necessary to provide the Service to you. You retain all ownership rights in your Content. We do not sell your Content to third parties or use it for any purpose beyond operating and improving the Service for you.
5. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
You may use the intended features for lawful marketing activities for your business, including creating and planning promotional content. Separate written consent from O2O Insights GmbH is not required for this. You are responsible for complying with applicable laws and third-party rights.
- In any way that violates any applicable national or international law or regulation
- To send or arrange unlawful advertising, unsolicited bulk advertising (spam), or promotional messages without legally required consent or another legal basis permitting them
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
- To use the Service in any manner that could disable, overburden, damage, or impair the Service
6. Intellectual Property
The Service and its original content, features and functionality remain the exclusive property of O2O Insights GmbH and its licensors. The Service is protected by copyright, trademark and other laws in Germany and other countries. Our trademarks and trade dress may not be used in connection with products or services without our prior written consent. This does not affect the editorial use of provided press material expressly permitted in the legal notice.
7. Termination
You may cancel paid subscriptions at the end of the agreed billing period. You can cancel through available account functions, the Paddle customer portal or by emailing info@elevateone.ai. We may terminate with at least 30 days’ notice effective at the end of the agreed term. We may end free access with 30 days’ notice.
Both parties retain their right to terminate for good cause. For remediable breaches, we will generally allow a reasonable period to remedy the breach or issue a warning. Immediate termination is permitted only where the legal requirements are met. Temporary suspension may be necessary to address specific security risks, unlawful activity or a legal obligation; it will be limited to the necessary scope and duration.
Your right to use the service ends when the agreement ends. You may request an export of your content within 30 days. Personal data is handled in accordance with applicable data protection and retention requirements; termination does not extinguish statutory rights or claims. If we end an already paid period early for reasons for which you are not responsible, we refund unused prepaid fees proportionately.
8. Limitation of Liability
Our liability is unlimited for intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions, in particular product liability law. The same applies within the scope of any guarantee we expressly provide.
For ordinary negligence, we are liable for breaches of essential contractual duties whose fulfillment enables proper performance of the agreement and on whose observance you may normally rely. Such liability is limited to loss foreseeable at the time of contracting and typical for the agreement. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law.
These provisions also apply for the benefit of our legal representatives and agents performing contractual duties. Mandatory claims, in particular under Article 82 GDPR, are not restricted. There is no blanket exclusion for data loss, lost profits or other consequential loss; the liability rules above apply.
9. Service and AI output
The agreed scope of service follows from the offer, the selected plan and any individual agreements. Statutory rights in relation to defects remain unaffected. We do not disclaim responsibility for the agreed service through a general “as is” clause.
AI analyses, suggestions and generated content may contain errors. Review them before making business decisions or publishing them, in particular for accuracy, third-party rights and legal compliance. No particular commercial outcome is promised. ElevateOne does not replace individual legal, tax or other professional advice; our contractual duties and the liability rules in section 8 remain unaffected.
10. Governing Law
German law applies. Where you act as a consumer, mandatory protections of the country of your habitual residence remain unaffected. Statutory jurisdiction rules and rights remain in place. Failure to exercise a right does not constitute a waiver.
11. Changes to Terms
Changes to existing service agreements generally require your consent. We provide proposed changes and their intended effective date at least 30 days in advance in text form, for example by email. Silence or merely continuing to use the service does not constitute consent. Without a valid agreement, the previous version continues to apply.
Changes required by mandatory law and purely administrative corrections that do not impair your rights, prices or agreed scope of service remain possible. Material changes to service, term or fees are not made unilaterally. Termination is governed by section 7.
12. Payments, Subscriptions & Refunds
Paid orders are processed through Paddle as merchant of record. The Paddle entity responsible for your purchase and its buyer terms are identified at checkout. Those terms govern your purchase and payment relationship with Paddle; our terms govern your use of ElevateOne. The prices, services, taxes and billing periods stated when ordering are binding.
Subscriptions and billing
Monthly and annual subscriptions renew in accordance with the validly agreed term unless cancelled. You may cancel at any time effective at the end of the current billing period, including through the link in Paddle’s confirmation email or Paddle support. Mandatory legal rules, in particular for consumer contracts, take precedence. The free Pro trial does not become a paid subscription without a separate paid order.
Refund policy
For your first paid subscription, we continue to offer a voluntary 14-day money-back guarantee from the first purchase. Request it at info@elevateone.ai. For purchases through Paddle, refunds are processed through Paddle. This additional promise does not restrict statutory withdrawal or defect-related rights or any further rights under validly agreed Paddle terms. Outside the guarantee, refund requests are assessed under applicable contractual and statutory rules.
Tax refunds
Refunds of taxes collected by Paddle depend on statutory requirements and Paddle’s buyer terms. Paddle generally specifies a request period of 60 days from the transaction and requires supporting evidence; mandatory statutory rights remain unaffected. Contact Paddle directly for assessment.

Price changes
The agreed price remains in place for billing periods already agreed and paid. We announce changes for future periods at least 30 days in advance in text form and agree them with you. Silence or continued use does not replace required consent. Without a valid change, the existing price applies; ordinary termination remains possible under section 7.
